The Plymouth Conservation Commission held its regularly scheduled meeting on Monday, March 24, 2008 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, William Wennerberg, III, Vice chairman and commissioners Christopher Brink, Gerre Hooker, John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

7:30 PM Town of Plymouth-DPW/Environmental Mgmt., Plymouth Long Beach-Ryder Way and Warren Avenue, Plat 39/Lot(s) 3, 10A-1, 10A-2, 10A-3, 10A-4, 10A-5, 10B. A Notice of Intent for the implementation of a Beach Nourishment Plan for a southern portion of Plymouth Long Beach.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Dave Gould represented the applicant and explained this is one of 3 nourishment projects that the town is working on. Southern portion of the beach would be sanded. Much of the cobble would be covered allowed for more use of the project. Any material added to this area would migrate north. Material would come from Camelot Park, dumped over the seawall and excavators would used to move the sand. Material is compatible and is slightly courser. Impacts are minimal and temporary for recreation improvements.
750 truck loads from approval to May 31.
John Scagliarini would like to see ongoing beach nourishment plan for the southern end of the beach.
Christopher Brink asked about negative impacts and John Ramsey said that equipment impacts could negatively impact the beach.

Letter from DFW dated 3-19-08 was read into the record.
Bill Abbott, 33 Herring Way asked for part of the beach to be affected. From Guard Shack to just before the end of the parking lot. First phase of larger project and he asked what larger project was to come. John Ramsey said more to the north and work would occur below the mean high water. He further asked about monitoring of the soil coming from Camelot. John Ramsey said that an inspector would be present and sampling from Camelot. David Gould said that the site has been approved.
Diane Boretos, West Falmouth, questioned wildlife during
Stephanie Fugazy, Tidal Beaches Committee expressed support of the beach.
William Wennerberg motioned to approve the project with conditions. The motion was approved unanimously.
8:00 PM Town of Plymouth-DPW/Environmental Mgmt., A Notice of Intent for the dredging of approximately 66,000 cubic yards of material from Plymouth’s Inner Harbor between the T-Wharf and the Plymouth Yacht Club.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
David Gould, Town of Plymouth Environmental Manager represented the Town.
Mass Seaport granted in 2004 the monies for this project. Shellfish, eelgrass, and other sampling has been completed in 2 boring basins.
Martha Rhinehart of Vine Associates, to address shoaling issues and navigation issues of the harbor. Mooring space would be improved. Maintenance and improvement dredging is proposed.
Area 1 – 6 ft. mooring basin, near Yacht Club, 4.2 acres maintenance dredging and 1.5 acres of improvement dredging.
Area 2 8 ft. mooring basin, 196000 square feet,
Area 3- Town Pier, 12 ft. moorning basin
Dredging done mechanically, barged and taken to Mass Bay disposal site. Project will avoid intertidal dredging and everything is under the water dredging. Eel grass beds are not affected. Time of year restriction is proposed to avoid various fish habitat needs – Feb 1 to July 31 no work.
EOEA has issued their Certificate and now Chapt 91 and ACOE will be sought along with the 401 Water Quality Certificate.
Paul Withington asked what no inter-tidal dredging meant. Area between low water and mean high water mark. John Scagliarini confirmed the placement of the silt curtains and will surround Area 1. John also questions the contamination of the soils and Dave said that sampling has been going on for 10 months and they are confident that it will pass. Martha explained the process.
Public Comment:
Jack May, representative of the Plymouth Yacht Club asked about the phasing and it would be accomplished through the federal funding.
Letters from DFW and Div. Marine Fisheries were noted in the record.
William Wennerberg motioned to approve the project with conditions. The motion was approved unanimously.

Dept., Plymouth Long Beach-Ryder Way and Warren Avenue, Plats 37A and 39/Lots: Various parcels on Plymouth Long Beach (see Notice of Intent for complete description). A Notice of Intent for the implementation of the Plymouth Long Beach Management Plan, that provides for the protection of rare and endangered species of wildlife and habitat, and for recreational uses including off-road vehicles.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.

Evelyn Strawn, the Chair, reminded the Commissioners that the hearing for continued for DEP File Number, NHESP comments, comments from Tidal Beach Committee and response comments from the Environmental Department.
Souther Barnes of Tidal Beaches Committee supported the Plan and chair read their Memo into the record.
John Scagliarini encouraged the Tidal Beaches Committee to push the Beach Nourishment Plan. Souther Barnes, representing the Tidal Beaches Committee said the start of the nourishment will be a testing time.
Evelyn Strawn asked David Gould to please be creative about a plan for the leasing of the dogs on the beach. Mr. Gould said that a Plan is being worked on.
Gerre Hooker motioned to approve the project with conditions. The motion was approved unanimously.
Other Business:
Continued discussion on the bylaw/reg changes. Gerre Hooker discussed extension of permits. She wants the PCC to consider closely before automatically extending for 3 year terms.
